AquaSense Privacy Policy

Welcome to AquaSense. This Privacy Policy explains how Hadl, Inc. ("we," "us," or "our") collects, uses, discloses, and protects information in relation to the AquaSense desktop application and its associated services (collectively, the "Application").

This policy is intended to help you understand your privacy rights and how we handle your information when you use our Application.

1. Information We Collect

We collect several types of information to provide and improve our Application:

A. Information You Provide to Us

  • Account Information: When an account is created for you under your organization's Master Agreement, we collect personal information, such as your full name, email address, job title, and company affiliation.
  • Communications: If you contact us directly for support or other inquiries, we may receive additional information about you, such as the contents of your message and any other information you choose to provide.

B. Information Collected Through Your Use of the Application

  • Service Data: This is the primary data you generate by using our Application. It includes:
    • The digital images of water and shrimp samples you capture using your connected microscope.
    • The analytical data, reports, and results generated from those images (e.g., plankton counts, biovolume, tubules analysis).
    • Metadata associated with your Service Data, which may include farm location or health status of a sample.
  • Usage and Device Information: We automatically collect technical information about how you interact with our Application, including:
    • Device information such as your operating system type and version.
    • Log data, which may include IP address, application activity (like features used and clicks), and crash reports.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • To Provide and Maintain the Application: To authenticate you as a user, process your captured images, generate analysis reports, and operate the core functionalities of our service.
  • To Improve Our Services: We use Service Data, including the captured images and their associated metadata (such as farm location and health status), to train, develop, and improve our computer vision models, AI algorithms, and the overall accuracy and capabilities of the Application. This use is subject to the terms of the Master Agreement with your organization.
  • To Communicate With You: To respond to your support requests, send you service-related announcements, and provide you with information about updates.
  • For Security and Compliance: To protect the security and integrity of our Application, enforce our Terms of Service, and comply with legal obligations.

3. How We Share and Disclose Your Information

We do not sell your personal information. We may share your information in the following circumstances:

  • With Service Providers: We share information with third-party vendors and service providers who perform services on our behalf. This is limited to what is necessary for them to perform their functions and includes:
    • Cloud Hosting: We use Amazon Web Services (AWS) to store and process all collected information.
  • Within Your Organization: Other authorized users within your organization may have access to the information and reports you generate, subject to the terms of the Master Agreement.
  • For Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
  • To Comply with Law: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, or prevent fraud.

4. Data Security and Retention

A. Security We implement reasonable administrative, technical, and physical security measures designed to protect your information from unauthorized access, use, or disclosure. This includes using industry-standard encryption for data in transit and at rest. However, no electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

B. Retention Our data retention practices distinguish between your personal account information and the service data.

  • Personal Information (e.g., your name, email): We retain this information for as long as your user account is active. It will be deleted upon a verified deletion request, subject to the terms in Section 6.
  • Service Data (e.g., images, reports, metadata): We retain all Service Data for as long as your organization"s Master Agreement is active. Following the termination of the Master Agreement, we will delete Service Data unless your organization has provided consent (as part of the Master Agreement or other written consent) for us to retain the Service Data for the purpose of service improvement and AI model training, in which case it may be retained indefinitely.

5. International Data Transfer

Our services and data are hosted and processed in Singapore on Amazon Web Services (AWS) data centers. If you are using the Application from outside of Singapore (including from the United States or Europe), please be aware that your information (including all Personal Information and Service Data) will be transferred to, stored, and processed in Singapore. By using our Application, you consent to this transfer, processing, and storage.

6. Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information. In compliance with applicable US state privacy laws, including (where applicable) the California Consumer Privacy Act (CCPA/CPRA) and the Delaware Personal Data Privacy Act (DPDPA), we provide residents of those states with the following rights:

  • The Right to Know and Access: You have the right to request information about the categories and specific pieces of personal information we have collected about you.
  • The Right to Correct: You have the right to request that we correct inaccurate personal information that we maintain about you.
  • The Right to Delete: You have the right to request the deletion of your personal information, subject to certain exceptions.
  • The Right to Opt-Out of "Sale" or "Sharing": We do not "sell" your personal information in the traditional sense. Under California law, "sharing" can include providing data for cross-context behavioral advertising, which we do not do.
  • The Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.

How to Exercise Your Rights and Scope: You may exercise your rights by contacting us at hello-aquasense@hadl.ai. Please note the scope of these rights in our B2B context:

  • These rights apply to your Personal Information (e.g., your name, email, and account details).
  • These rights generally do not apply to the Service Data (captured images, reports, metadata). This data is generated on behalf of your organization and is governed by the Master Agreement. Requests for the access, correction, or deletion of Service Data must be made by an authorized representative of your organization.

7. Children's Privacy

Our Application is a professional tool and is not directed to individuals under the age of 16. We do not knowingly collect personal information from children under 16.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new policy on our website or through the Application.
